Divorce Law in Virginia
Virginia divorce law provides married couples the right to file no-fault and fault complaints for divorce. No-fault divorce is appropriate when a marriage has broken down with no chance of reconciliation. A no-fault divorce can be obtained after a period of separation, regardless of fault. Fault divorce is found when domestic violence, adultery, and other misconduct is present. If domestic violence is a concern, we will obtain protective orders and no-contact orders for abused victims. How do you know when it is time to say goodbye?
You may want to ask yourself the following questions if you are considering a divorce. This is not an all-inclusive list, and certainly many other questions can and should be asked.

  • Has there been physical violence in the relationship?
  • Besides your children, do you and your spouse have mutually enjoyable activities that you share and look forward to together?
  • Do you and your spouse talk? Communication is an essential part of any relationship and if communication fails, many times the relationship fails.
  • Obviously you were at one time "in love" with your partner but do you still genuinely like your partner?
  • Are you and your partner willing to work on problems in the relationship in an effort to make the marriage work and move forward?
